Application Privacy Policy

eMetric, LLC (“eMetric”) considers the privacy and security of users of its Applications to be of paramount importance. This Privacy Policy is intended to inform users of eMetric’s policies and procedures regarding the collection, use, and disclosure of personally identifiable information and non-personal information eMetric receives from educational entities.

Before using this Application, please read this Privacy Policy carefully. By using this Application, you acknowledge that you understand, accept, and agree to the terms of this Privacy Policy.

eMetric provides assessment technology solutions to certain education entities ("Education Agency") in support of specific assessment programs ("Program"). This Privacy Policy explains eMetric's privacy policy with respect to the personal information collected through this Application.

This Privacy Policy applies to eMetric Applications including the following:

Who has access to this Application?

For secure iTester and Data Interaction portals: Access to the Application is restricted by password to users authorized by the Education Agency sponsoring such Program. The Education Agency is responsible for authorizing educator access to this Application, or providing eMetric with such authorized user information. Some features of this Application may not be accessible to all users.

For iTester kiosks and apps: The kiosks and apps are used to deliver assessments to students. Student log-in information is provided by the student’s school or school district. Students are not requested to enter any personal information while using the kiosks and apps.

For Parent Portals: The Education Agency that authorizes parent and student access to this Application will provide parents and/or students with applicable account log-in information through the student's school or school district. eMetric will not directly provide parents or students with specific user identification or password information. If you are a parent or student with questions about gaining access to this Application, please contact your school or school district for more information.

For public Data Interaction sites: Access to the Application is open to any user via a published URL. The Education Agency’s rules for data suppression are applied as directed.

What information do we collect?

The Application provides authorized users access to data, including student information and score information, for the purpose of fulfilling its Program responsibilities with the Education Agency for which such personal data is collected.

eMetric does not seek to collect personal information from parents or students through this Application. For Parent Portals, parents and students must obtain their account log-in data from their school or school district. Students under the age of 13 are specifically requested to not provide any personal information through this Application. Parents and students should direct all inquiries related to this Application to their school or school district.

When you access or use the Application, we may use a variety of technologies that collect and store information about how the Application is accessed and used. This information may include:
(a) device-specific information regarding User’s device which is used to interact with the Application
(b) the location of User’s device(s) (country, state, and area code)
(c) system configuration and information about the individual components of User’s device
(d) errors generated during User’s session
(e) information about User’s navigation and interactions while using Application
(f) questions or inquiries with customer service or technical support (collectively, “Services Information”).

eMetric shall have the right to store Services Information and to
(a) share Services Information with partners and state agencies
(b) perform data analyses for the purpose of improving eMetric products or services or developing new products or services.

How is information used?

Except for the limited exceptions set forth below, eMetric will not share with, or disclose to, third parties, the names of users, students, or other personally identifiable information collected through or in connection with this Application. eMetric may, however, disclose personally identifiable information:

(a) as requested or required by the Education Agency for the Program;
(b) pursuant to a legal request, subpoena, or other process that requires disclosure of information;
(c) in connection with the sale, joint venture, or transfer of some or all of the assets of eMetric subject to written approval from the Education Agency; and/or
(d) to affiliated companies and contractors providing services for the Program who are obligated to take appropriate commercially reasonable steps to maintain the confidentiality of such information and use it solely for the purposes specified in this Privacy Policy.

Non-personally identifiable aggregated information collected through this Application may be used for quality assurance purposes and may be used to increase the functionality and user-friendliness of the Application.

What about cookies and website analytics?

The Application may use cookies to measure traffic patterns, personalize content and control security. A cookie is a small file placed on the hard drive of your computing device through your browser or app. You may refuse to accept browser cookies by activating the appropriate setting on your browser. The Application may collect IP addresses, the associated URLs, domain types, the browser type used to access the Application, the country, state and telephone area code where the users' Internet service provider's servers are located, the pages of the Application that users viewed during their visit and any search terms entered on the Application. Collection of IP addresses is generally for system administration purposes, to monitor the level of activity on the Application and for security reasons.

The Application may use Google Analytics, a service which transmits site traffic data to Google servers in the United States. Google Analytics does not identify individual users or associate your IP address with any other data held by Google. We may use reports provided by Google Analytics to help us understand site traffic and webpage usage, and to identify problems and improve service. How do we protect personal information collected by this Application?

Subject to the other provisions of this Privacy Policy and contractual obligations, eMetric will take commercially reasonable steps to maintain the confidentiality of all personal information and student records collected and managed through this Application. For example, this Application currently uses industry-standard SSL encryption to protect user account and password information and uses a secure connection to eMetric servers, which are protected by firewalls to prevent unauthorized break-ins. The administrative system and authentication mechanisms are protected through the use of SSL encryption of data transmitted via HTTPS. As other security methodologies become commercially available, eMetric may change its current security systems processes or substitute these systems with other security systems or processes. UNFORTUNATELY, NO DATA TRANSMISSION OVER THE INTERNET IS GUARANTEED COMPLETELY SECURE. GIVEN THE INHERENT OPERATION AND STRUCTURE OF THE INTERNET, ALL TRANSMISSIONS ARE DONE AT YOUR OWN RISK.

User information and access to this Application is password protected for the privacy and protection of student personal and student assessment data. Users are urged to keep confidential all user information and passwords. If storage of this information is required, it is recommended that it be kept in a secure location. To protect data, users should always logoff when exiting this Application and not divulge or share user identification or passwords with anyone

What websites/sites does this Privacy Policy cover?

To assist users, this Application may contain links to other websites related to the Program on the Internet, which may include Education Agency sites, or other websites. The information practices of those websites are not covered by this Privacy Policy or any other policies or terms applicable to this Application. You should read the terms and policies of those other websites.

What about changes to this Privacy Policy?

This Privacy Policy for this Application may be revised from time to time through an updated posting. You should, therefore, check this Privacy Policy periodically. Revisions are effective upon posting and your continued use of this Application following the posting of such revisions will indicate your acceptance of such revisions.
